These Terms of Service (“Terms”) govern your access to and use of Kioskt (the “Service”), operated by Kioskt (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. By using it, you represent that you meet this requirement and that the information you provide is accurate.

2. Your account

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly of any unauthorised use. We verify email addresses before granting access; you agree to provide a valid email address.

3. Your content

You retain ownership of the content you create and publish on Kioskt. By submitting content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display that content for the purpose of operating and promoting the Service. This licence ends when you delete the content or your account, except for content that has been shared with others or that we must retain to comply with law.

You represent that you own or have the necessary rights to the content you submit, and that it does not infringe the rights of others.

4. Acceptable use

You agree not to use the Service to:

post content that is unlawful, infringing, defamatory, harassing, hateful, or obscene;
impersonate any person or misrepresent your affiliation;
upload malware, or attempt to gain unauthorised access to the Service, other accounts, or our systems;
scrape, overload, or interfere with the Service or its security features;
infringe intellectual property or privacy rights; or
violate any applicable law or regulation.

5. Moderation and termination

We may review, remove, or restrict access to content, and suspend or terminate accounts, at our discretion, particularly where content or conduct violates these Terms or harms the Service or its users. You may stop using the Service and delete your account at any time from your account settings.

6. Intellectual property

The Service itself (including its name, design, software, and branding) belongs to Kioskt and is protected by intellectual property laws. These Terms do not grant you any right to our trademarks or software except as needed to use the Service normally.

7. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, availability, or that the Service will be uninterrupted or error-free. Content published by users is their own; we do not endorse it.

8. Limitation of liability

To the fullest extent permitted by law, Kioskt will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service.

9. Indemnification

You agree to indemnify and hold Kioskt harmless from any claims, damages, or expenses arising out of your content, your use of the Service, or your violation of these Terms.

10. Governing law

These Terms are governed by the laws of Australia, without regard to its conflict-of-laws rules. Any disputes will be subject to the courts of that jurisdiction.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and continued use of the Service after changes take effect constitutes acceptance.
